Terms and Conditions

 Definitions:

1.  "Client" means the person or entity hiring Swanky Sips mobile cocktail bar.

2.  "Hire Period" means the agreed period of time during which Swanky Sips mobile cocktail bar will be provided to the client.

3.  "Mobile Cocktail Bar" means Swanky Sips mobile cocktail bar and all its equipment and accessories.

4. Swanky Sips agrees to hire the mobile cocktail bar to the Client during the Hire Period subject to the terms and conditions set out in this agreement.

5. The Client acknowledges that they have inspected the Mobile Cocktail Bar and that it is in good working condition at the commencement of the Hire Period.

Clients Responsibilities:

1. The Client shall provide suitable access to the venue at the agreed time for the Swanky Sips mobile cocktail bar and ensure that there is a suitable area for the bar and slushie machine to be set up.

2. The Client shall be responsible for ensuring that the venue is suitable for the Swanky Sips mobile cocktail bar and that all necessary permissions and licenses have been obtained for the mobile cocktail bar to be used at the venue/site.

3. The client will ensure the availability of a power source and a suitable area for the mobile cocktail bar setup.

4. The client will communicate any specific requirements, flavours, or dietary restrictions in advance.

5. The Client shall be responsible for any damage to the Swanky Sips mobile cocktail bar and/or its equipment caused during the hire period (including slushie machine).

6. The Client agrees to be liable for the full cost of repair or replacement of any equipment damaged during the hire period.

7. The Client agrees to make the Swanky Sips mobile cocktail bar and its equipment available for collection by Swanky Sips at the end of the hire period which is agreed upon by the Client and Hirer.

Responsibilities of the Swanky Sips:

1. The Swanky Sips mobile cocktail bar will provide the agreed-upon number of slushie machines, equipment, and necessary supplies.

2. The Swanky Sips mobile cocktail bar will ensure that the slushie machines and equipment are clean, safe, and in proper working condition.

Payment and Cancellations:

8.  A non-refundable deposit of $100 is required 14 days before event to secure the booking of the Swanky Sips mobile cocktail bar.

9. The remaining balance must be paid in full to Swanky Sips 48 hours prior to or on the day of the event.

10. Payments can be made in cash or through electronic methods as agreed upon by both parties. (Client and Hirer).

11.  In the event of a cancellation by the client, the non-refundable deposit will not be returned.

12. If cancellation occurs within a specified period (e.g., 14 days) prior to the event, the client may be responsible for additional charges.

13. In the unlikely event that the mobile slushie bar is unable to provide the agreed-upon services, all payments made by the client will be refunded.

Cancellation Policy:

Cancellation by the Client

1. The Client may cancel the booking by providing written notice to Swanky Sips

2. The following cancellation fees will apply:

• 14 days or more prior to the hire period: No cancellation fee.

• Less than 14 days prior to the hire period: 50% of the total hire fee.

• Less than 7 days prior to the hire period: 100% of the total hire fee.

Cancellation by Swanky Sips

1. Swanky Sips may cancel the booking at any time prior to the commencement of the hire period due to circumstances beyond its control, in which case the client shall be entitled to a full refund of any amounts paid to Swanky Sips.

2. Swanky Sips reserves the right to cancel the booking at any time if the Client fails to comply with the terms and conditions of the hire agreement.

Refunds

1. In the event of cancellation by the Client, Swanky Sips will refund any amounts paid by the Client, less the applicable cancellation fee as set out.

3. Refunds will be made within 14 days of receipt of written notice of cancellation from the Client.

Changes to the Booking

4. 4Changes to the booking may be made subject to availability and agreement by Swanky Sips.

5. Any changes to the booking may be subject to additional fees, which will be agreed between the parties.

By hiring Swanky Sips mobile cocktail bar, the Client acknowledges and agrees to the cancellation policy set out above. The Client agrees to pay the applicable cancellation fee in the event of cancellation and acknowledges that changes to the booking may be subject to additional fees.

PAYMENT TERMS

Payment Schedule

1. A non-refundable deposit of 50% of the total hire fee is required to secure the booking. The remaining 50% of the total hire fee is due 14 days prior to the commencement of the hire period.

2. For bookings made less than 14 days prior to the commencement of the hire period, full payment is required at the time of booking.

Payment Method

3. Payment may be made by bank transfer, credit card or debit card or cash on the day with prior agreement.

4. Swanky Sips will provide the Client with an invoice for the deposit and final payment.

Late Payment

5. If the Client fails to make payment in accordance with the payment schedule, Swanky Sips reserves the right to cancel the booking and retain any amounts paid.

6.  All payments must be made in AUD i.e. Australian dollars. 

By hiring Swanky Sips mobile cocktail bar, the Client acknowledges and agrees to the payment terms set out above. The Client agrees to pay the non-refundable deposit and remaining hire fee in accordance with the payment schedule and acknowledges that late payment may result in the cancellation of the booking and the retention of any amounts paid.

Limitations and Liabilities:

1. Swanky Sips shall not be liable for any loss, damage or injury arising from the use of the mobile cocktail bar, including any loss, damage or injury arising from any defect in the mobile cocktail bar or its equipment.

2. The liability of Swanky Sips shall be limited to the cost of repair or replacement of the Mobile Cocktail Bar or its equipment in the event of any damage caused during the Hire Period.

3. Swanky Sips shall not be liable for any loss of profits, business or anticipated savings or any other indirect or consequential loss arising out of or in connection with the hire of the mobile cocktail bar.

4. This agreement constitutes the entire agreement between the parties and supersedes all previous agreements and understandings between the parties.

Agreement:

1. Both parties acknowledge that they have read and understood these terms and conditions and agree to be bound by them upon booking the mobile slushie bar services.

2. By signing this agreement, the Client acknowledges and agrees to the terms and conditions of Swanky Sips mobile cocktail bar hire service and accepts liability for any damage caused to the mobile cocktail bar or its equipment during the hire period. 

3. This agreement constitutes the entire agreement between the parties and supersedes all previous agreements and understandings between the parties.

Unforeseeable Circumstances:

1. Neither party will be held responsible for any delays or failures in performance resulting from circumstances beyond their control, including but not limited to natural disasters, extreme weather conditions, or other unforeseen events.

Health and Safety:

1. The mobile slushie bar will adhere to applicable health and safety regulations, including food handling and hygiene practices.

2. The client is responsible for ensuring that guests with known allergies or medical conditions are aware of the ingredients used in the slushies.

Unforeseeable Circumstances:

1. Neither party will be held responsible for any delays or failures in performance resulting from circumstances beyond their control, including but not limited to natural disasters, extreme weather conditions, or other unforeseen events.
